By accessing or using our Sites, you accept these Terms and any terms included by reference. If you do not accept these Terms, you are advised not to use our Sites.

Periodically, we may update these Terms. Should there be any changes, we will notify you, such as by email, through a notice on our Sites, or by updating the date at the top of these Terms. Unless stated otherwise in our notice, the revised Terms will take immediate effect. Your continued engagement with our Sites after such notice will serve as your agreement to the changes. If you disagree with the revised Terms, you are required to cease using our Sites.

Your Consent to Use of Data and Mobile Communication & Our SMS Program Terms

You agree to receive communications from us regarding the Site and the Committee through SMS, text messages, emails, or other electronic methods. Standard rates and fees set by your carrier for messaging, data, and other services will be applicable to these communications.

The Committee and the carriers involved do not assure the delivery of messages. The Committee reserves the right to terminate the program at any moment without prior notification.

Our Ownership & Your Limited License

The Site, including all its texts, graphics, images, photos, videos, illustrations, and other content, is owned by the Committee or our licensors and is safeguarded by both U.S. and international laws. Unless explicitly indicated in these Terms, all rights to the Site are held by us or our licensors. Provided you adhere to these Terms, we grant you a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use the Site for your personal, non-commercial purposes. Unauthorized use of the Site beyond what is expressly permitted by these Terms, without our explicit prior written consent, is strictly forbidden, will result in the termination of the license granted herein, and infringe upon our intellectual property rights.

Trademarks on This Site

BlueVote.org, along with our logos, slogans, and the design of the Site, are trademarks owned by the Committee and cannot be replicated, imitated, or utilized, either partially or fully, without our explicit written consent beforehand. All other trademarks, registered trademarks, product names, and names or logos of the Committee mentioned on the Site belong to their respective owners. Mentioning any products, services, processes, or other information by trade name, trademark, manufacturer, supplier, or any other reference does not imply or indicate our endorsement, sponsorship, or recommendation of them.

Your Feedback & Submissions

You have the option to voluntarily share with us inquiries, remarks, feedback, proposals, concepts, or any other details regarding the Committee or our Site, as well as creative works and other materials like photos, writings, narratives, or different types of content (“Submissions”). You acknowledge that we can utilize these Submissions for any aim, whether commercial or not, without any recognition or payment to you. This includes, but is not limited to, the right to develop, duplicate, publish, or enhance the Submissions according to the Committee's exclusive judgment. You also understand that the Committee may regard any Feedback as not confidential.

Our Site's Third-Party Content & Additional Sites.

We may present information related to organizations, events, products, services, or activities from third parties, or permit third parties to share their content and information on or via the Site (referred to as “Third-Party Content”). Offering Third-Party Content is a service to those who might find such content valuable. Your interactions with third parties, as well as your engagement with or use of any Third-Party Content, are strictly between you and the third party. The Committee does not have control over, nor does it endorse, and it does not make any claims or guarantees about any Third-Party Content. You access and use such Third-Party Content at your own risk.

Indemnification Clause

To the maximum extent allowed by law, you agree to indemnify, defend, and hold harmless the Committee, its independent contractors, service providers, consultants, successor entities, joint committee members, and their respective officers, directors, agents, partners, and employees (collectively known as the “Indemnified Parties”) against any losses, liabilities, claims, demands, damages, costs, or expenses (“Claims”) that arise due to (a) the content or feedback you provide; (b) your breach of these Terms; (c) your violation, misappropriation, or infringement of someone else’s rights (including intellectual property rights or privacy rights); or (d) your wrongful actions related to the Site. You commit to immediately informing the Indemnified Parties of any claims by third parties, collaborating with the Indemnified Parties in defending against such claims, and covering all fees, costs, and expenses incurred in the defense against such claims (including attorney's fees). Moreover, you consent to the Indemnified Parties having the authority to manage the defense or settlement of any third-party claims, at the sole discretion of the Indemnified Party.

Disclaimers

Your interaction with our Site is entirely at your own risk. Unless explicitly stated by us in writing, our Site and any content provided on it are offered on an “as is” and “as available” basis, without any kind of warranty, whether express or implied. This includes, but is not limited to, implied warranties of merchantability, suitability for a specific purpose, title, and non-infringement. Furthermore, the Committee does not guarantee that our Site is accurate, complete, reliable, up-to-date, or free from errors. Although the Committee strives to ensure a safe experience on our Site and its content, we cannot guarantee that our Site or servers will be free from viruses or other harmful elements. The full responsibility for the quality and functioning of the Site falls on you.

Liability Limitations

Under the maximum extent allowed by law, the Committee, along with its contractors, service providers, consultants, successor entities, joint committee members, and their respective officers, directors, agents, and employees, shall not be held liable to you for any damages that arise under any theory of liability—including contract, tort, negligence, strict liability, warranty, or any other basis—for any indirect, consequential, exemplary, incidental, punitive, or special damages or for lost profits, even if these parties were previously informed about the possibility of such damages.

The total liability of the Committee and associated parties for any claims related to these Terms or our Site, irrespective of the action's nature, will not exceed the larger amount of $50 or the total you have paid to access our Services.

Governing Law and Jurisdictions

Any disagreement stemming from these Terms and your interaction with the Site shall be regulated, interpreted, and enforced following Pennsylvania's laws, except when superseded by U.S. federal law, without applying conflict of law provisions or principles (from Pennsylvania or any other area) that might mandate the enforcement of another jurisdiction's laws. Disputes between the parties will be settled in the state or federal courts located in Lehigh County, Pennsylvania, within the United States.

Modifying and Termination of Use of Our Site

We reserve the right to alter, suspend, or cease offering our Site or parts of it whenever we choose. Similarly, you are entitled to discontinue using our Site whenever you wish. We bear no liability for any loss or damage that arises from your inability to access or utilize our Site.

Severability Clause

Should any clause or portion of a clause in these Terms be deemed illegal, void, or incapable of enforcement, such clause or part thereof shall be considered detachable from these Terms, leaving the validity and enforceability of the rest of the provisions unaffected.

Miscellaneous Terms 

The Committee's decision not to assert or implement any right or clause of these Terms does not constitute a waiver of that right or clause. The headings used in these Terms are meant merely for ease of reference and hold no legal or contractual significance. Unless specifically stated otherwise within this document, these Terms are designed only for the advantage of the involved parties and do not aim to grant rights to any third parties. You consent to the idea that our interactions and transactions can be carried out through electronic means.
